ELIGIBILITY

The “We Know You’re Out There: Big Mountain Freeskier Search” (the "Contest") presented by Doglotion.com (Contest Host) is open to individuals residing in Canada (male or female) who have reached the age of 16. Not valid where prohibited by law. Employees of Doglotion.com and Mountain Hardwear and their respective affiliates, sponsors, advertising and promotion agencies and members of the immediate family (parent, child, sibling and spouses) and of the household in which all such persons are domiciled are not eligible to enter. The Contest is subject to all federal, provincial and local laws and regulations.

To complete your entry you must read and agree to these terms and conditions. Participation in this contest constitutes full and unconditional agreement and acceptance of these contest rules.

HOW TO ENTER

No purchase is necessary to enter this contest. To enter, visit the Official Entry page at http://hardwear.doglotion.com/entry and complete the entry form including text responses, photos, and video(s). The Contest will begin at 11:00:00 AM (PST) on March 15, 2010 and will end at 11:59:59 PM (PST) on April 15, 2010 (the "Contest Period"). Limited to one entry per person.

All entries that are incomplete, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Terms and Conditions may be disqualified by the Contest Hosts. The Contest Hosts take no responsibility for lost, delayed, misdirected, late or erased entries, or for typographical or other production errors. The Contest Hosts are not responsible for any errors or omissions in printing or advertising the Contest.

PROPERTY OF ENTRIES

Upon submission, all text content from the entries become the property of the Contest Host, and may be used in any and all future promotions. The Contest Hosts shall have the unrestricted right to use, edit, publish, broadcast, or stream in any or all of the text Entries as well as the name, statements, biographical information and likeness of any and all participants without further approval.

The Contest Host however will not claim ownership of contest entry photos & videos, and will request permission for future use beyond storage of the media on this contest site.

WINNER SELECTION

The Contest winner will be determined by a panel of judges comprised of Doglotion.com and Mountain Hardwear representatives. All Entries will be judged for creativity, demonstrated strengths for a test team role, personality, skiing/snowboarding ability, and video/tech skills. The Contest hosts want your entry to show why you are passionate about backcountry skiing and ski mountaineering, and why you would excel as a Mountain Hardwear gear tester. The panel’s decisions regarding any and all aspects of the Contest are final.

PRIZING

The prize for the one (1) selected winner is a gear sponsorship from Mountain Hardwear, up to an approximate retail value of $2500 CAD.

Some restrictions may apply. Any difference between stated approximate retail value and actual prize will not be awarded. All aspects of the prize are subject to availability and subject to change. Specific product models are for example only.

ACKNOWLEDGEMENT

By entering the Contest, participants are hereby deemed to:

• acknowledge that they are solely responsible for their own Entries and the consequences of publishing these entries online
• warrant that their Entries are their own original work and do not infringe any other person’s rights, and
• indemnify, defend and hold harmless the Contest Hosts and each of their directors, officers, employees, partners, sponsors, prize suppliers and their agents for all liability resulting from or related to any claims, actions, damages, losses or costs arising by reason of this Contest and their participation therein including, without limitation,:
  • infringements of intellectual property rights,
  • public dissemination of the Entries, and
  • invasion of privacy, libel or slander related to the Entries.

PRIVACY

By entering the Contest, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Contest and for the purposes of understanding the needs and preferences of individuals or to develop, enhance, market and/or provide products and services. The Contest Hosts will collect, use and disclose personal information in accordance their privacy policies.

WINNER NOTIFICATION

The selected winning Entrant will be notified by e-mail and/or phone on or about April 20, 2010.
Before being declared a winner of any prize, the selected entrant will be required to sign a declaration and release form confirming compliance with Contest Rules and acceptance of prizes as offered; acknowledging the non-responsibility of the Contest Hosts and their respective agents with respect to injuries, accident, loss or misfortune relating to the prize; and acknowledging the Contest Hosts and their respective agents' right to publish or broadcast the winner's picture, name, address, voice and statements without charge or further compensation other than the prize offered.

Before being declared a winner the selected Entrant will be required to sign a
Test Team’ agreement contract outlining the blogging obligations, test team conduct, and feedback obligations of the winner.

In the event that a selected entrant is not eligible to claim their prize or does not claim their prize within two weeks of the draw, or is unwilling or unable to comply with the Rules or Ambassador agreement, or any prize notification or prize is returned as undeliverable or call is not returned within five (5) days, that entry will be disqualified and a new entrant will be selected from remaining eligible entrants until such time that the prize has been successfully awarded.
The contest winner is solely responsible for the reporting and payment of any applicable taxes on their prize. Winner may waive their right to receive a prize. All contest prizes are non-transferable, non-exchangeable, and non-refundable, have no cash value and must be accepted by the winner as awarded. The Contest Hosts reserve the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond their control. The Contest winner will be posted at http://www.thefreeskiersearch.com.

Entrants acknowledge that this is a Doglotion.com contest. By entering the Contest, entrants acknowledge that they have read, understood and agreed to be bound by the Rules.

RELEASE

By entering the Contest, entrants acknowledge that they are releasing the Contest Hosts and their respective affiliates, sponsors, advertising and promotion agencies and the immediate family and household members of the above, and each of their respective affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize, including any travel, skiing or snowboarding related thereto (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). By entering the Contest, entrants also agree to fully indemnify Doglotion.com and Mountain Hardwear and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, related companies, suppliers, sponsors and agents and hold each of them harmless from any and all claims costs, losses, or damages of any kind arising out of or in connection with the Contest, including any use of the Prize, by any third parties.

CANCELLATION OR MODIFCATION OF CONTEST

If, for any reason, the Contest is not capable of running as planned by causes which, in the sole opinion of the Contest Hosts, may affect the administration, fairness, integrity or proper conduct of this Contest, the Contest Hosts reserves the right, in its sole discretion, to modify, cancel or suspend the Contest.
